A. Three-Day Right to Cancel (Required by California Law)
IMPORTANT NOTICE — YOUR RIGHT TO CANCEL
You may cancel this contract at any time prior to midnight of the third business day after signing.
To cancel, notify us in writing: nayeon@everguardinc.com
Any deposit paid will be refunded in full within 10 days of receiving your cancellation notice.

B. Mechanics Lien Warning (Required by California Law)
MECHANICS LIEN WARNING
Anyone who helps improve your property but is not paid may record a Mechanics Lien on your property. Even if you pay your contractor in full, unpaid subcontractors or suppliers may record liens and sue you in court. To protect yourself, obtain a lien release from all subcontractors before making final payment.
Required under California Business & Professions Code Section 7159
C. Payment Terms & Schedule
Deposit: 10% of total contract price (not to exceed $1,000) due upon acceptance.
Deposit is refundable within the 3-day cancellation period. After that period, non-refundable if client cancels.
Final Payment: Due in full upon project completion and final walkthrough.
Accepted Methods: Cash, Check (payable to Everguard Painting Inc.), Zelle.
Late Fees: 1.5% monthly (18% per annum) on balances unpaid after 7 days from completion.
D. Workmanship Warranty
2-Year Workmanship Warranty from date of project completion.
Covers: peeling, blistering, and cracking from improper application.
Excludes: abuse, neglect, chemical damage, natural weathering, UV fading, acts of nature.
E. Workplace Environment & Mutual Respect
Zero-tolerance policy for verbal abuse, harassment, or discriminatory behavior toward our staff.
We reserve the right to pause or terminate the project if team safety or dignity is compromised. Payment due for work completed.
Client agrees to provide safe access and a professional environment for our crew.
F. Scope of Work & Change Orders
Any additional work beyond the original scope requires a written Change Order signed by both parties BEFORE work begins.
Color changes after paint purchase will incur additional material and labor charges.
Verbal agreements for changes are NOT binding.
G. Specialized Work & Contingencies
Discovery of dry rot, mold, or structural damage not visible during estimate: billed at $85.00/man-hour plus materials, with written Change Order.
Hazardous materials (lead, asbestos, toxic mold): not covered. Separate certified specialist required.
H. Administrative Terms
Media Release: Client grants permission to use Before & After photos/videos for marketing. Client may opt out in writing.
Communication: All instructions and change orders must go through the Project Supervisor only.
Proposal Validity: 30 days from date of issue.
